“No Jurisdiction”: Supreme Court Rules Bar Council Cannot Discipline Law Students

NEW DELHI: In a landmark verdict asserting the autonomy of legal academic institutions, the Supreme Court of India ruled today that the Bar Council of India (BCI) has no statutory authority or jurisdiction to take disciplinary action against law students. Setting a clear boundary between enrolled legal professionals and students in training, the apex court affirmed that disciplinary control over students rests strictly with their respective universities.

The ruling was delivered by a bench headed by Chief Justice Surya Kant, alongside Justices Joymalya Bagchi and V. Mohana. Quashing previous communications issued by the BCI directing action against graduating students at NALSAR University of Law, Hyderabad, the court made its earlier interim orders absolute, shielding students and faculty from any punitive or criminal measures initiated by state or central bar councils.

Addressing the fundamental legal question of regulatory jurisdiction, the apex court clarified that while the BCI is empowered under the Advocates Act, 1961, to prescribe standards for legal education, that power does not extend to policing student conduct within universities.

“As far as the conduct of law students is concerned, the Bar Council of India has neither jurisdiction nor statutory competence. That falls exclusively within the domain of the educational institution or university,” the bench observed, drawing a firm distinction between a law student and an enrolled advocate.

The court explained that the BCI’s regulatory role kicks in only when a graduate applies for official enrollment as an advocate. At that stage, the BCI holds full authority to review an applicant’s background—including any past acts involving moral turpitude—to evaluate whether they meet enrollment requirements. However, the court held that the regulator cannot issue pre-emptive bans or attempt to dictate disciplinary actions while a student is actively pursuing their degree.
